How does Breach of Contract affect the Histology Traveler?

It’s February and you decide to leave New York to winter in Florida. It’s your first assignment. You are really excited to start and find out what the traveling histology lifestyle is all about. You are working an awesome day shift 6-2:30, Monday through Friday. This is great because this shift allows you time after work to go to the gym, go to the beach and explore the area. This feeds the adventurous side of your personality. It’s perfect! One week into your assignment, you are asked to work the midnight shift, Tuesday through Saturday. This is not at all what was written in your contract. This was not the agreement. You would never have taken the assignment if it were a midnight job. Your agent won’t help you because as long as you are there, they make money. Suddenly they care more about the client than you. Although you love your apartment and you love the area, you now hate your hours. What do you do?

Say no! Stick to the contract. Tell them you plan to abide by the provisions of the contract. Any modifications will need to be renegotiated, rewritten and approved by both your agent and your attorney. Now wait for their next move. If they say they can no longer use your services and release you, they have broken the contract. This is Breach of Contract. A breach of contract occurs whenever one or more of the parties fail to perform their agreed upon obligations. This breach makes them liable for the money you would have made if the contract went to completion. It also makes them liable for any other expenses that you may have to pay due to the breach. They have to make you whole.

Making one whole is a way of correcting a breach of contract or other legal obligation. The idea is that damages must be awarded to put that person in the same position they would have been if the obligation was not broken.

Hopefully your unwavering perseverance will cause them to realize that contract violations are not prudent and come with consequences.
